Lorry Driver Sentenced for Smuggling 32 Migrants
Introduction
The National Crime Agency (NCA) has recently secured prison sentences for two lorry drivers involved in migrant smuggling at Dover Port. This case highlights the serious legal consequences for drivers who facilitate illegal immigration, a matter of critical importance for transport operators, drivers, and compliance professionals.
Details of the Offences
Sorin-Costinel Ivan, a 46-year-old Romanian driver, was arrested in September during an NCA operation supported by the Port of Dover Police, Kent police, and Immigration Enforcement. Ivan was found with 32 mostly Bangladeshi migrants concealed in the trailer of his HGV. Additionally, three bundles of cash totalling £9,950 were discovered in his cab. Although Ivan initially denied knowledge of the migrants, he later pleaded guilty to facilitating illegal immigration.
Another Romanian driver, Marius Bajenaru, aged 44, was also sentenced after 17 migrants were found hidden in the rear of his panel van. Nearly £4,000 in cash was recovered from his cab. Bajenaru admitted collecting the migrants from a layby on the A20 near Ashford and stated he was to be paid approximately £200 per person smuggled.
Sentencing and Enforcement Warnings
Ivan received a three-year prison sentence, while Bajenaru was sentenced to two years and eight months at Canterbury Crown Court. These convictions follow recent warnings from the NCA about an increase in cases where lorry drivers are recruited by criminal gangs to transport migrants within legitimate loads.
NCA senior investigating officer John Turner emphasised the risks, stating that criminal gangs portray this activity as a low-risk way for drivers to earn extra money. However, those caught face possibly life-changing prison sentences. He also highlighted the disregard these networks have for the safety of the individuals they smuggle, treating them as commodities.
Implications for Transport Operators and Drivers
This case serves as a stark reminder of the legal and ethical responsibilities of drivers and transport operators. Facilitating illegal immigration not only carries severe penalties but also endangers vulnerable individuals. Operators should ensure robust compliance measures are in place to prevent involvement in such activities and provide clear guidance to drivers on the risks and legal consequences.
