Inquiry into Compliance Failures

An inquiry was held to assess operators’ adherence to licence undertakings, focusing on service punctuality, vehicle maintenance, driver defect reporting, and overall transport management systems. Evidence from Bus Users Scotland highlighted concerns about the reliability and timeliness of services operated by the companies involved.

The Commissioner noted that passenger complaints and monitoring data showed services were not consistently running to schedule. This inconsistency undermined public confidence and potentially breached licence conditions.

Findings on Operational and Maintenance Shortcomings

The inquiry examined whether the operators failed to run services as registered and if they had taken adequate measures to address punctuality issues. The Commissioner found that both companies did not meet expected compliance standards. Key issues included:

  • Inadequate systems for reporting and rectifying vehicle defects
  • Failures to ensure vehicles were roadworthy and maintained according to declared inspection intervals
  • Weak oversight by Transport Managers

A significant incident involved a bus catching fire while in operation. The vehicles in question had been acquired from another large Scottish operator.

Regulatory Action and Warnings

Despite these failings, the Commissioner acknowledged efforts by both operators to improve compliance through investment in new systems and personnel changes. However, deterrent action was deemed necessary to uphold statutory requirements and meet public expectations.

McGill’s Bluebird Ltd was ordered to pay a penalty of £29,700 for failing to operate services according to registered timetables. This payment was made to Scottish Ministers under section 39 of the Transport (Scotland) Act 2001.

Commissioner Turfitt stated:
“I make very clear that these operators can no longer use the poor state of vehicles as an excuse for failing to meet published timetables. Both are given a final warning. I find the repute of each entity to be severely tarnished by the finding of maintenance issues identified at the hearing … Any further reports are likely to result in consideration of more extensive intervention. I also take account of the previous reports of poor punctuality. ”

Transport Managers were reminded of their statutory duties and the importance of proactive oversight.

Ongoing Monitoring and Future Implications

The Commissioner directed that future operations will be closely monitored. Any further failings may lead to more serious regulatory action.
