Introduction

From 1 July 2026, certain transport operators carrying goods between the UK and the EU will need to comply with assimilated drivers’ hours and tachograph regulations. Understanding these changes is essential for operators, drivers, and compliance professionals to ensure legal adherence and avoid penalties.

Scope of the New Requirements

The new rules apply to operators using goods vehicles or vehicle and trailer combinations weighing more than 2. 5 tonnes. This includes vehicles transporting goods for hire or reward, and also those carrying goods on own account where driving is the driver’s main activity.

Operators must:

  • Comply with assimilated drivers’ hours rules
  • Ensure affected vehicles are fitted with Smart Tachograph version 2
  • Use the tachograph to record driving time, rest periods, breaks, and other work activities

These requirements do not apply to operators carrying their own goods if driving is not the driver’s main activity. Additionally, vehicles weighing 3. 5 tonnes or less that operate solely within the UK are exempt.

Actions for Operators

Operators should verify whether their vehicles fall within the scope of the new regulations. If so, they must ensure compliance before undertaking any relevant international journeys.

Given the high demand for tachograph installations, operators who have not yet equipped their vehicles with the required devices are advised to act promptly to avoid delays.
